TERMS & CONDITIONS

APPLICABILITY.

1.1 These terms and conditions (hereinafter: conditions) are applicable on all orders and agreements with Design Refresh

1.2 Accepting an offer or placing an order shall mean that you accept these conditions.

PRICES AND PAYMENT

2.1 Unless otherwise stated or agreed on in writing, the prices stated for the products and services offered shall be in euros, including VAT and excluding handling and shipping costs, any taxes or other levies.

2.2 Products are delivered upon receipt of payment, unless agreed otherwise.

2.3 Payment must be made without discount or compensation in advance.

2.4 If the prices for the products and services increase in the period between the order and the execution thereof, this price increase shall not be passed on, except for price changes resulting from changes in VAT rates or other taxes or levies.

DELIVERY/SHIPPING

3.1 The delivery dates stated by Design Refresh shall merely be indicative. You shall not be entitled to any damages if a delivery date is exceeded, nor shall you be entitled to cancel the order or rescind the agreement.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHT

4.1 You must respect all intellectual and industrial property rights attached to the products delivered by Design Refresh in full and unconditionally.

COMPLAINTS AND LIABILITY

5.1 If you do not wish to take possession of a product for any reason, you shall be entitled to return the product to Design Refresh within 7 working days after delivery. Return shipments shall only be accepted in this case if the product and packaging have not been damaged, with the return shipment costs being borne by you as well.

5.2 Return shipments with insufficient postage shall not be accepted.

5.3 The return shipments accepted by Design Refresh shall be replaced with a substitute product, or the original invoice amounts refunded excl. postage & handling costs, as soon as possible. Refunds shall be given within 30 days of recept of the returned product.

5.4 Design Refresh shall not assume any liability whatsoever for damage claims or consequential damage in whatever capacity substantiated as a result of the use of its products by consumers or third parties.

ORDERS

6.1 Design Refresh Shop shall not be liable for misunderstandings, mutilation, delays or improper transmission of orders and messages resulting from the use of the Internet or any other means of Design Refresh or between Design Refresh and third parties, insofar as pertaining to the relation between you and Design Refresh, unless and insofar as there has been an intentional act/omission or gross negligence on Design Refresh his part.

APPLICABLE LAW AND COMPETENT COURT

7.1 All rights, obligations, offers, orders and agreements to which these conditions apply, as well as these conditions themselves, shall be governed solely by Slovak law.

7.2 All disputes between the Parties shall exclusively be brought before the competent court in the Slovakia.
